The WV/NPDES Stormwater Program requires operators of construction sites that disturb one (1) acre or
greater, including smaller sites that are part of a larger common plan of development, to obtain
authorization to discharge stormwater under a WV/NPDES Construction Stormwater General Permit. When the
construction activity is owned by one person but operated by another, it is the responsibility of the owner
(developer) to obtain the permit. When the construction activity is completed and all disturbed areas are
stabilized, the responsible party must submit a Notice of Termination (NOT) in order to end coverage under
the General Permit.
If you are going to disturb one acre or greater you are required to first obtain a stormwater construction
permit. All applications for coverage under the construction stormwater general permit must be submitted
through WV DEP's Electronic Submittal System (ESS).
2019 General Permit
The 2019 Construction Stormwater GP was issued January 10, 2019 and became effective February 9, 2019.
Response to Public Comments
Berkeley Springs Bypass (WVR110602)
Beallair Homes, LLC (Reissuance of WVR104140)
Registration No. WVR104140 has been reissued to continue coverage of construction activities associated with
a Single Family Residential Community Subdivision and associated improvements in Jefferson County, WV. This
permit registration was originally issued on 02/13/2009 and superseded GP Registration No. WVR101303.
Reissuance #1 2013 was issued on 08/15/2013 for 46.9 acres. Under this reissuance, an additional 1.6 acres
will be added along the northeastern portion of the site for a stockpile area, changing the total proposed
disturbed area to 48.5 acres.
Kart Mitigation Plans
A GPP containing a Karst Mitigation Plan shall be submitted with applications for registration under this NPDES General Stormwater Permit. This plan is for all areas within Karst Topography.
The areas that could contain Karst Features are shown on the "Interactive Mapper" within Section VI. of the "New/Reissue NPDES/State Storm Water Construction" Application within the
Electronic Submission System (ESS).
Fee Schedule
To help the applicant, the application fees have been calculated by acreage in each precipitation zone in
West Virginia. These application fees have been prepared using the NPDES Fee structure to simplify the
application submittal process.

Chesapeake Bay Addendum Form
Sites located in Berkeley, Grant, Hampshire, Hardy, Jefferson, Mineral, Morgan or Pendleton counties must
complete the Bay TMDL Addendum and submit it with their application.
